Jeremy Hogan@attorneyjeremy1 · Mar 11 I only had time tonight to skim-read the new proposed stablecoin bill, the humbly named "Genius Act." A couple of thoughts and a big QUESTION I need help with: 1. As many people in the comments have already mentioned, passage of this Act would be the death of USTD in the U.S.. 2. This bill is thick and meaty. It addresses a LOT of things, including the interaction of U.S. federal laws on stablecoins with foreign laws and state laws, etc..  I honestly couldn't take it all in. 3. The reserve requirements, AML requirements, etc. all fall neatly for RLSUD and USDC. 4. Bigger picture, the legislation is explicitly making plans for stablecoins to interact with the traditional digital banking system. The "merge" is being planned. My Question: The Genius Act requires that the issuer of any stablecoin have the "...technological capability to comply...with the terms of any lawful order." Later, the Act defines the required technological capabilities as the issuer's ability to "...freeze, burn of prevent the transfer of payment stablecoins..." SO, can Ripple or Circle actually freeze RLUSD or USDC once it's transferred??  I didn't think that was possible, for either. Thank You! 저는 오늘 밤 새로 제안된 스테이블코인 법안을 훑어볼 시간밖에 없었습니다. 겸손하게도 "Genius Act"라고 명명되었습니다. 몇 가지 생각과 제가 도움이 필요한 큰 질문:  1. 댓글에서 많은 사람들이 이미 언급했듯이, 이 법안이 통과되면 미국에서 USTD가 죽을 것입니다. 2. 이 법안은 두껍고 육즙이 많습니다. 스테이블코인에 대한 미국 연방법과 외국법 및 주법 등의 상호 작용을 포함하여 많은 것을 다 다루고 있습니다. 솔직히 저는 모든 것을 이해할 수 없었습니다.  3. 준비금 요건, AML 요건 등은 모두 RLSUD와 USDC에 깔끔하게 들어맞습니다. 4. 더 큰 그림에서, 이 법안은 스테이블코인이 기존 디지털 뱅킹 시스템과 상호 작용하도록 명시적으로 계획을 세우고 있습니다. "병합"이 계획되고 있습니다.  제 질문: Genius Act는 모든 스테이블코인 발행자가 "...합법적 명령의 조건을 준수할 수 있는 기술적 역량"을 가져야 한다고 요구합니다. 나중에 이 법안은 필요한 기술적 역량을 발행자가 "...결제 스테이블코인의 이전을 동결, 소각 또는 방지할 수 있는 능력..."으로 정의합니다.  그러면 Ripple이나 Circle이 실제로 RLUSD나 USDC를 이전한 후에 동결할 수 있을까요?? 저는 그것이 가능하다고 생각하지 않았습니다.  감사합니다!

 

Eleanor Terrett@EleanorTerrett · Mar 11 🚨NEW: The updated text of @SenatorHagerty’s stablecoin bill - the GENIUS ACT - has dropped.  Skimming through the PDF and noticed the section on ‘Reciprocity for Payment Stablecoins Issued in Overseas Jurisdictions’ has been expanded beyond the February text to include “reserve requirements, supervision, anti-money laundering and counter-terrorism features, sanctions compliance standards, liquidity requirements, and risk management standards, to facilitate international transactions and interoperability with United States dollar-denominated payment stablecoins issued overseas.”  🚨새로운 소식: @SenatorHagerty의 스테이블코인 법안인 GENIUS ACT의 업데이트된 텍스트가 삭제되었습니다. PDF를 훑어보니 '해외 관할권에서 발행된 지불 스테이블코인에 대한 상호주의' 섹션이 2월 텍스트에서 확장되어 "해외에서 발행된 미국 달러화 지불 스테이블코인과의 국제 거래 및 상호 운용성을 용이하게 하기 위한 준비금 요건, 감독, 자금 세탁 방지 및 테러 방지 기능, 제재 준수 기준, 유동성 요건 및 위험 관리 기준"이 포함되었습니다.
